When [current Blazers assistant coach] Kim Hughes, then an assistant coach for the Los Angeles Clippers, was found to have prostate cancer on the eve of training camp in 2004, he learned what it was like to work in Donald Sterling's world.

Hughes wanted to postpone surgery. The disease ran in the family, usually slowly. But after Coach Mike Dunleavy encouraged Hughes to get another opinion, the second doctor urged Hughes to have surgery quickly. When Hughes contacted the Clippers about his health insurance coverage, he was told the surgery was not covered. If they made an exception for him, they would have to do so for everyone.

The cost would be $70,000.

Hughes went ahead and had the surgery anyway. Unknown to him, four players - Chris Kaman, Corey Maggette, Elton Brand and Marko Jaric - chipped in to cover Hughes's cost for the operation.

I think Matt may have alluded to this earlier but it's a story I hadn't heard before. Donald Sterling is a horrible person.

Q: Can Silver force Sterling to say whether the voice on the tapes is his?

A: Yes. Under the terms of Paragraph 24(m)(ii) of the "constitution" that governs the 30 owners of NBA teams and establishes the authority of the owners' commissioner, Silver can require Sterling to respond under oath to questions. The commissioner has "the right to require testimony and the production of documents and other evidence from any Member." As an owner, Sterling is a "member" of the NBA. Sterling and his lawyers could delay answering questions from Silver, but if Sterling refuses to admit or to deny that it is his voice on the tapes, he is in violation of the constitution and would face termination. He has no protection from the U.S. Constitution's Fifth Amendment guarantee against self-incrimination, because he is not facing any charge of any crime

Q: What penalties can Silver issue?

A: Under the provisions of the bylaws, Silver has two sets of powers that he may use. Under either, he can issue a lifetime suspension and a substantial fine. Under Paragraph 24(l) of the constitution that was adopted by the NBA owners on Oct. 26, 2005, he can issue a fine of up to $2.5 million, can suspend an owner indefinitely and can order the forfeiture of draft picks.

In another provision, Paragraph 35(A)(c), Silver can issue an indefinite suspension and a fine of $1 million to any owner who "makes ... a statement having or designed to have an effect prejudicial or detrimental to the best interests of basketball."

Q: Is it possible for Silver and the NBA to terminate Sterling's franchise ownership?

A: Yes. Under the terms of Paragraph 13 of the constitution, the owners can terminate another owner's franchise with a vote of three-fourths of the NBA Board of Governors, which is composed of all 30 owners.

another NBA owner suggested an interesting penalty, designed to use "soft-power" to pressure sterling to sell the clippers.

Like Cuban, Alexander interpreted the NBA constitution to not allow the commissioner to have the power to remove an owner except for gambling. However, Alexander said he suggested to Silver that all the Clippers players could be given the option to become free agents after this season, a step toward driving Sterling out of the league.

FWIW, while I thought it was a little weird that Kareem focused so much on how the person who made the tape should be arrested, he is technically correct. California requires all parties consent to recording, and a violation appears to be a misdemeanor offense. Still kind of odd that he focused so much on that.

I don't think he focused on it to any strange degree. He gives it two paragraphs in order to support his point that the "making and release of this tape are so sleazy" and that we probably should have been outraged over sterling's earlier offenses, which were more substantial and acquired through less sleazy means. It is the same point others have made on ILX, and it is OTM. There's nothing odd about it.

I know it's not what happened.

I know that Sterling is a douche who got caught being douchey and his co-owners wanted him gone for a while, and Silver knew he'd look awesome for doing it as early as he could.

BUT

Imagine just for a second that Sterling planned this whole thing. It is really not too far outside the realm of possibility. It would not take a Kaiser Soze or Petyr Baelish to pull this off.

I know it would have just been easier and less public and possibly more profitable (although I don't see how THAT'S possible) to just put the team up for sale, so I'm not sure if this was a thing that makes sense pragmatically. Like, would this brouhaha increase value? Possibly by way of publicity?

Thoughts?

As first reported by NBC News, Donald Sterling will file a lawsuit against the NBA for forcing a sale of the Clippers, and he'll reportedly seek more than $1 billion in damages. ESPN's Ramona Shelburne adds that Sterling is still deciding whether to sue Shelly Sterling too. And here comes Woj, saying Sterling could file a separate suit to stop the sale of the team.
