If you didn't consent to be anally penetrated, you could declare this a case of rape or indecent assault, depending on the language of the applicable law. (Some older laws penalize rape only when a woman is the victim.)

There's not enough information in the question to give any kind of reasonable answer.

I guess this is the part where someone could question the sincerity of the question citing NOT the "guys never say no" double standard, but instead the "this is dave q and we've read his posts before so because it's him (with his history) we're skeptical". What the fuck would someone be doing to just wake up and "Oh, hey, there's a finger up my ass!"? Wouldn't you have noticed it like way earlier? I can't even answer the question because I can't think of a conceivable way this could happen, short of like a minor drug overdose knocking ya out.

It's really nice to wake up being made love to - it'd be really sad if no-one did that anymore for fear of being accused of rape.

I would say that the "intimacy conventions" of your relationship with the other person would define whether or not it was rape.

If it was a one night stand person then it's going a bit far. If it's someone more familiar but you were an arse-virgin or not interested in arse stuff then it's going a bit far but if it's something you have done previously together and both feel comfortable with then maybe it's not going to far.

But then that's like saying that a husband technically can't rape his wife, which is bullshit of course.
