I've never sued anyone but I've read over lots of civil court documents. Don't be nervous but if you are in the right (and kept good documentation) then you shouldn't have too much of a problem.

i think i'm in the right. i'm pretty sure. but its going to cost me money to get there and i'm going to be relying on "experts" and one of the experts is the insurance company who don't want to pay me (no, its not them i'm suing)

In a settlement, though, if you are favored you can usually get the other party to cover court costs. But yeah, it is a hassle. You should check to see if there is any community or (university, I don't know if you are still in school) legal help available for free. Or even hit up some law students, they'll usually be able to spout off a lot of non useful info but be able to give you some clue about what chance you would have and what technicalities you'll have to go through.

Don't count on it, at least in America. The other side is usually pissed off to be dragged into court. Have you exhausted all other possibilities, gaz? Litigation is pure psychic torture even you are totally winning.

Technically, I sued my dad when I was about 10 or 11. We'd been in a car crash where he was legally at fault, so me and my mum sued him to get his insurers to pay us compensation.

If there is an insurance company involved, even if liability is an issue in your case, there's still a good chance if you won't have to go to court. Of course, I'm thinking of the way things are in Canada (I'm a lawyer), so maybe they are different in the states.
I'm not sure I'd ever call the insurance company expert at anything, though. heh. Guess it depends on the case.
