This law firm is intellectual property and litigation counsel to Excelsior Software (http://www.excelsior-usa.com/home.html). It has come to our attention that you are publishing a book and a record by this name. It is also the title of a popular thread on your domain.

Please be advised that Excelsior Software is the holder of the trademark "Excelsior," which the United States Patent and Trademark office has accepted for registration on the Principal Register.

You are hereby warned and notified to CEASE AND DESIST your use of the term "Excelsior", which you have obviously registered and continue to use in bad faith. If you do not immediately cease and desist we will take all action necessary to protect our mark. Your failure to comply will result in my client's full and forceful prosecution of all of its rights, and you could incur liability for damages in excess of $100,000 and responsibility for our attorneys' fees.

Dear Excelsior College, if you have 'copywrited' the term Excelsior, it means you have put it in an advertisement written by a copywriter. If you have 'copyrighted' it, on the other hand, you have asserted intellectual property rights in limited areas. Neither case should give anyone here any cause for concern.
