And the law is the law. Whether its liked or not. Either he adheres to it or he should be prosecuted.

I got a real sense of disappointment, but I'ma do like deej said and do my part to hold dude's feet to the fire (just like I loudly promised to everyone I'd do to Kerry).

He hasn't lost the sheen for me, but the sheen was always more about 'hey maybe an actually liberal smart guy winning the presidency and doing some vaguely liberal shit' than about dude being Eugene V. Debs or whatever.

I'll sigh about FISA, console myself that he's right about the war, and cast my vote for him in hope that he'll work with a new Democratic majority to make some shit happen.

i mentioned this in the other thread but this whole fisa update bill situation has been on some serious smokey back room business for a while - telecom immunity was reported as being all negotiated and just awaiting a meaningless vote at least twice and i was all mad - then it didnt happen

so im gonna wait and see what does or doesnt pass and what obama does or doesnt vote for this time before i get all pissy

J0hn, you're not wrong to be pissed about this - FISA's definitely an encroachment on civil liberties - but 100 Democratic Reps. voting "no" isn't equal to 100 profiles in courage. It's easy to vote no when you know you're going to lose. I'm not happy with Obama, and not to come off like an apologist or anything (Greenwald was right about that), but he's going to have to make a few crappy choices.

Anyway, I don't know if it's as cut-and-dry as we're making it out to be. Obama's old colleague Cass Sunstein, who used to be at UChicago and is moving to Harvard Law this fall, wrote a piece saying that FISA might not be unconstitutional, and recently in the New Republic he wrote a piece saying that Obama had read the piece and called him before his vote to talk about the bill. Apparently Obama thought it was illegal, but wanted to have a debate about it (and he said they had a fascinating conversation and Obama had lots of detailed arguments/rebuttals) before making any statements on FISA to the press. Now, his vote aside, can we acknowledge the awesomeness of that - at least compared to the last eight years?

I've never thought that was a debatable issue, but I'm not a law professor, and maybe it's debatable. That'll be a grand intellectual exercise, won't it! Like a good game of Constitutional chess. What fun. Meanwhile, the Senate is about to take away the power of US courts to demand that the telecoms tell us -- tell *anybody* -- who they were spying on, who told them to do it, and just how illegal it was (and is). I can't prove anything, but I have a sneaky suspicion that there has been shit going on for the last five years that will make The Lives of Others look like a ride at fuckin' Disneyland. And FISA is nothing but a piece of legislation designed specifically to keep us from ever finding out. And I'm 100% with johnD and will get in line to kick Obama in the nutsack over this. (And then still vote for him.)
