The worst part of it is creating a precedent that Congress can suspend the Constitution at will and exonerate the Executive branch retroactively when it violates the guaranteed rights of ordinary citizens. If this law gets past SCOTUS review, then the Constitution is a dead letter. I don't doubt Scalia and Thomas will vote to uphold this piece of excrement on the grounds that respecting our rights is too onerous a burden to place upon the government.
