No he couldn't.

Has Kushner still got the security clearance he surely shouldn't have ever been granted? If so how hasn't that been forcibly removed. Thought protocols for getting that were supposed to be objective.

Because he's such a reactive brainstem, the entire investigation could easily hinge on figuring out what exactly he was reacting to at any given moment. Like, he doesn't just sit in an empty room and come to a decision all on his own.
