Of course, I tactfully avoid this tricky situation by never making money for creative work

Karl Malone, Tuesday, 19 February 2019 18:49 (five years ago) link

i would get their permission first.

That’s not so easy as far as I can tell!

Heez, Tuesday, 19 February 2019 19:31 (five years ago) link

yeah, exactly - I mean, it depends on what you're doing. recently some dude wanted to use conferencecall.biz as part of his live performance so he contacted me ahead of time and of course i was cool with it. but the james brown estate is probably going to tell you to fuck off

Karl Malone, Tuesday, 19 February 2019 19:38 (five years ago) link

the ease of doing something doesn't really relate to whether or not it's the right thing to do. asking permission is clearly the right thing to do. if it is difficult and you think your request for permission may be denied, why not use something else or make your own thing or whatever?

weird woman in a bar (La Lechera), Tuesday, 19 February 2019 19:41 (five years ago) link

well i have asked, just haven't heard back. the funny thing is that it's something i added very late to the song and could take it off very easily (it's just played on the outro) or even make a different version of the beat but it sounds sooooooo good and i love it. but i also didn't perform it or record it so i feel weird using it. anyway, gonna keep trying to get permission for now... just wondering about ppls general feelings about this sort of thing

Heez, Tuesday, 19 February 2019 20:11 (five years ago) link

I respectfully disagree with La Lechera on whether or not it's clearly the right thing to do, although I will freely acknowledge that I hold a minority viewpoint on these kinds of things. i lean toward cory doctorow's views on copyright. as far as existing laws go, i think the visual arts world's lenient stance on reappropriating material makes much more sense than the music world's version, which just seems bonkers and overly restrictive imo, and way too accommodating to corporations.

with all that said, i totally support the idea that with music, at least, if you intend to profit in any way, or even think it's possible that you would in the future, you MUST get permission first. and if you can't, you should find another way to do it without sampling someone else's music. note that i don't think this is a good situation or that's how the perfect world would operate - there are plenty of visual artists who appropriate things all the time, and it's generally covered by fair use as long as you're doing something creative/artistic with it. and even when you're not (like a lot of richard prince's stuff, arguably), it's often covered by fair use(or not - he is permanently in litigation and there hasn't been a legal consensus). i wish music was like that too, but it's not. copyright is much more restrictive with music. so to prevent yourself from being sued, you have to ask permission first.

Karl Malone, Tuesday, 19 February 2019 20:42 (five years ago) link

I agree with both sides to some extent. If you're sampling a recording, you're going to have to contact the artist's label in most cases, so if you're not going to make any real money then it's not even worth alerting them to your existence. And some genres have a proud tradition of sampling, bootlegging, etc. It can still be a controversial topic though, even in terms of making a Bandcamp release of dance remixes/bootlegs of pop songs 'pay what you want'.

On the other hand, I personally go to great lengths to avoid it, and for me it's part of the fun to replay or recreate samples. And if I make a bootleg I won't charge for it, but I don't get mad if others do (especially if it's all-original production).

I'm not clearing a Fleetwood Mac drum loop I'm using on a new thing

You guys need some irl drummers :)
I don’t feel too strongly about it honestly, I just feel strongly about the act of asking for permission in general.

Well then, I can play that song in a jokey style without the drums: https://soundcloud.com/austin-anderson-337534977

So, THERE.

I'd love an IRL drummer but everyone I know is in like 3 bands!

i could stand to be in at least one more band tbh
every time i think something is getting off the ground, it stalls

Xxxxp thanks dog latin! I’ve always loved dance music, used to DJ, etc. it’s super-fun to be making a new type of music (aside from the band I’m in with shakey). The tracks we’ve put out so far are more like b-sides. Im excited about some of the other tracks even more. We got an amazing saxophonist to play on one track, and I have a couple of breakbeat tracks that I’m saving for a later release.

So I've been making my own tracks for a while now, and you can hear em here - https://soundcloud.com/pluwa. Not really sure how to describe them (which I know sounds super-pretentious), some are a bit Balearicy or ambient, some are a bit moodier...

my bandcamp was getting out of hand, so streamlined my it over the weekend. now the singles and non-long playing stuff have their own artist listings:

austinato*singles

the proper austinato artist page is still there; less massive now though.

new release from me: 'brooke's theme.'

also, i've been posting covers and oddball stuff on my soundcloud. apparently i do prince-sampling happy mondays covers now.. i'm actually pretty okay with this.

really lovely stuff, austin!

the 4th track was playing out of my crappy laptop speakers (sorry!) and for a second i thought i was listening to cleaners to venus!

you are a saint for listening!

thank you for the feedback — i am always simultaneously embarrassed and honored when my music gets compared to, like, actual music. i have never heard of cleaners from venus before; a quick google tells me that i have some investigating to do this weekend. double thanks!

Some new weird stuff from me:

HEP LAD - EP LAD H

EZ Snappin, Friday, 5 July 2019 20:13 (four years ago) link

Cool stuff, guys! I've been working on a bunch of electronic tracks, just need to master a bunch of stuff before putting it out as Balboa Park.

esby - I made a trip-hop version of your track that I'm pretty into, but I'm waiting on my cousin to finish some rapping for it, for which I have high hopes.

I've been having a blast with Max4Live MIDI LFOs in Live, attaching them to all sorts of stuff. My latest fave is attaching a random LFO to an arpeggiator Type parameter, so that the arp type changes every couple of bars. This makes for some neat, ever-changing apreggiations.

DJI, Monday, 8 July 2019 18:28 (four years ago) link

New recording of a classical guitar duo I wrote last year. The two guitars are in different tunings and mostly play harmonics, with some investigation of the acoustic effects you can get from slightly detuned pitches:

I like that one, I love harmonics and muted string scratches. Also, you probably don't want to hear that it would make good horror soundtrack music (to the laymen's ears).

change display name (Jordan), Friday, 19 July 2019 20:12 (four years ago) link

I take that as a compliment, actually. I like a lot of horror film scores.

Horror soundtracks are the greatest!!

weird woman in a bar (La Lechera), Friday, 19 July 2019 21:54 (four years ago) link

Ok cool, I just assumed that anyone ensconced in the world of 12 tone/new music/etc would be sick of people hearing their compositions as dissonant horror movie music :)

weird woman in a bar (La Lechera), Friday, 19 July 2019 22:12 (four years ago) link

i think horror music is the best. i even started a thread about it! horror soundtracks

weird woman in a bar (La Lechera), Friday, 19 July 2019 22:14 (four years ago) link

Ha, there was a new person at orchestral rehearsal tonight who I'm suspecting is not that used to playing new music. At the end, she commented that "it sounded a bit like a horror movie soundtrack". I asked "the last piece?" She replied "all of them".
