Biden Democrats serve the military's interests every bit as much as Republicans and more than Trump Republicans. If it had been Bernie or someone promising to trim military budgets, the love of the Constitution probably gets a good deal shakier.

I remember thinking back in '16 that a defense sec with the nickname "mad dog" (without knowing fuck all about him) within a Trump administration probably means lol we're all going to die, possibly much sooner than we might expect. But he resigned after not much time and obv hates Trump to this day. If you can't get the "mad dogs" on side amongst military top brass your dreams of dictatorship are going to be an uphill battle - with treacle in your boots.

I am not a lawyer, but in this case the judge gets to decide punishment (right?), and he's kind of tipped his hand a little by already establishing guilt. Also, there's no way to get, say, a deadlocked judge.

could swing either way I'd think--a jury sometimes hands down a huge $$ judgement that a judge probably wouldn't, but also a judge is less likely to be swayed by your bullshit if you're obviously guilty.

If I had to vaguely guess, besides being that's the only way he thinks, some part of him/the lawyers might be hoping for a 'see if we rile them up they'll act badly in response and then we can claim they really are biased.' But this does not strike me as very sound.

Neither. It's a civil trial, not criminal, so it has no effect on the outcome (no right to effective counsel in a civil trial). But theoretically Trump might have a civil cause of action against the attorney for malpractice.
