This whole thing is such a joke and his business seemingly ran the the emperor's new clothes, it makes me question the entire validity of the US economy as it seems like any moron with enough money can just get lawyers to make any stupidity go away.

As long as you don't get into Theranos or Enron or FTX total fuckery, you don't end up in REAL trouble.

Look at a dude like Michael Milken for all the BS he did, dude is still in business doing his thing.

All this and you can get choked out on the street for selling single smokes in America.

LOL I have an old fam friend who’s a total Trumper, married a very rich person and they live practically next door to Trump in NJ and she just posted a pic on instagram a few days ago and I was like “is she posting a pic of herself with Michael Mullen?!?!” Yes she was.

Lawyer’s nightmare scenario: When Trump takes the witness stand today, he needs to explain fraud allegations without committing perjury or invoke 5th Amendment privilege against self-incrimination, which allows judge, in this civil case, to infer the worst

Saw some suggestion that baiting the judge into losing his temper and overreacting to Trump bullshit is an actual possible Trump strategy and not just, like, rationalizing what may happen regardless.

Josh in Chicago, Monday, 6 November 2023 14:41 (five months ago) link

Yes, read a Rolling Stone feature quoting Dershowitz saying it could be a tactic to goad the judge into overreacting and thus strengthening post-verdict appeal as Trump winning the case in the courtroom is virtually impossible.

Yngwie Azalea (stevie), Monday, 6 November 2023 15:06 (five months ago) link

yah getting to be prez again is worth perjury and courtroom incitement-- in the same way paris was worth a mass.

i was gonna type "re-election is worth..." but decided he doesn't need actual re-election, since if he's on the ballot he'll just claim it anyhow.

Judge Engoron to Trump: "Please, just answer the questions, no speeches."

Judge added: "Some of your answers have not been responsive to the question."

Always worth a reminder: he has already been found guilty, this is about damages/penalty, and iirc, the/this judge gets to decide them.

Josh in Chicago, Monday, 6 November 2023 15:16 (five months ago) link

Going great!

Engoron: "I beseech you to control him, if you can."

The judge warns Kise that if he will control Trump if the lawyer doesn't.

Such genius

NYAG's counsel confronts Trump with the deed stating that "the Club and Trump intend to forever extinguish their right to develop or use the Property for any purpose other than club use."

Trump parses: "'Intend' doesn’t mean we will do it."

After Trump repeats his talking points about the disclaimer clause, Wallace tells him he already said that.

So far Trump's defenses have largely been along the line of "Yeah, I signed/said it, but I didn't mean it."

I know the criminal cases are juicier because of the dream of putting him behind bars, but I think this fraud case is going to be massively consequential for him, especially with the genius move of mouthing off to a judge who has sole discretion over his entire fortune.

Muad'Doob (Moodles), Monday, 6 November 2023 19:37 (five months ago) link

It probably works well for his fundraising side but when the judge is dismissing every defence from his attorney's as "whistling past the graveyard" you might think it's a terrible tactic and the level of disgorgement to come is going to be more high than low from what is already a high baseline!

This exchange making the rounds as a major gotcha:

Judge Engoran: Proceed.
NY AG lawyer: Mr. Trump, the court officer is handing you PX 416, Deutsche Bank, term loan agreement 2012. Let's go to page 6. Is that your signature?
Trump: Yes.
NY AG lawyer: Page 105, the guaranty, did you sign it?
Trump: Yes.
NY AG lawyer: This says "in order to induce lending" - you see that?
Trump: Yes.
NY AG lawyer: Little Roman i, it says as of June 30, 2011 - do you believe it was true and accurate?
Trump: Yeah, I do.

After Trump again brings up the disclaimer clause, giving a lengthy statement about how it is comprehensive and goes on forever, AG lawyer Kevin Wallace says, "Well, that clause isn’t the only thing that goes on forever."

“Trump testified that he believed he was worth more than his financial statements reflected, concluding: “Therefore, you have no case.”

As for the banks and insurers, Trump again pointed to the disclaimer clause, describing it as an extensive caveat that “goes on forever.”

Kevin Wallace, the lawyer for James’ office who was questioning Trump, replied: “Well, that clause isn’t the only thing that goes on forever.”

In between battling the judge, Trump’s lawyers heaped praise on their client, with Kise calling Trump’s answers “great” and “brilliant,” even while admitting, “I’m just not sure what he’s answering.” Kise also referred to Trump as the “former and soon-to-be chief executive of the United States.””

Reading this almost made me miss being a newspaper reporter, covering courts

On his way out of court, Kise further applauded Trump’s performance, telling reporters: “In 33 years, I’ve never had a witness testify better.”

The level of sycophancy that this guy demands is so gross. Just odious.
